We primarily process personal data that we receive as part of our business relationship with our customers and business partners based on an order or other contractual relationship or in correspondence (electronically or by post) from these and other people involved, or that we receive in connection with the operation of our website or other applications.

We collect your data primarily from you. To the extent permitted, we also receive personal data from publicly accessible sources (e.g. media, internet). Due to our activities, data may also be made available to us by third parties, in particular your employees, any agents, authorities, etc. It is possible that we receive information about you in the context of correspondence and meetings with third parties and people in your environment (e.g. references, your address for deliveries) so that we can conclude or process contracts with you.

The extent of the data we store depends on the inventory and the type of order/contractual relationship. our business relationship with you. As a rule, this includes your name, address, birthday, residence permit, marital status, email address, homepage, telephone numbers and your professional activity. Data processing is justified by your consent, the agreement of a contract or pre-contractual measures, the fulfillment of legal regulations, our interests and other relevant legal bases.

We would like to point out in particular that we outsource various business activities to ensure our services. In particular, financial services, quality management and the IT area could be outsourced. In this context, it is essential that we pass on to third parties the data that we have received from you directly, through a customer/business partner or from a third party. We only use the data provided to us for the contractually agreed purpose, namely to provide the service to the customers themselves. If we commission third parties to process your data, in these contractual cases we ensure that they also comply with data protection regulations.

 

2.2 Visiting our website

When you access our website, the browser used on your device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:

• IP address of the requesting computer,

• Date and time of access,

• Name and URL of the retrieved file,

• Website from which access is made (referrer URL),

• Browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

We use the data mentioned to ensure a smooth connection to the website, comfortable use of our website, evaluation of system security and stability and for other administrative purposes. Data processing is justified by an overriding interest arising from the purposes listed above. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

2.3 Purpose and legal basis for data processing

We only process your data for specified purposes and only in legally permissible cases, namely to fulfill the contract between Eugen Hofmann and you, to start and maintain our business relationship with you. Furthermore, your data may be used in connection with the guarantees of our operations, the assertion of legal claims (as well as defense), to prevent and investigate criminal offenses and other misconduct.

The legal basis for data processing includes your consent, the execution of a contract or pre-contractual measures, the fulfillment of legal regulations, the overriding interests of us or third parties and other relevant legal bases.

3 Release to third parties

As part of the provision of our services and the provision of our website, we may rely on the services of third parties. Under certain circumstances we are also obliged to disclose your data to authorities or other third parties. This particularly concerns the following data transfers:

If the level of data protection in the country in which data is transferred does not correspond to that of Switzerland or the European Union, we contractually ensure that the same protection as in Switzerland or the European Union is guaranteed. 3.1 Retention period / deletion

You may also be able to have the processing of your personal data restricted or object to it. Please note, however, that we are obliged by commercial and tax law to retain booking documents for at least 10 financial years or longer. We can therefore neither delete nor edit the personal data contained in these documents. In this case, your request for deletion will therefore only be fulfilled after the retention period has expired.

If services are still outstanding at the time of receipt of your objection, revocation and request for deletion, your personal data will continue to be processed until the business relationship has been completely terminated. Your data protection revocation expressly has no influence on the processing of existing contractual relationships and is not considered an extraordinary reason for termination.

We reserve the right to change this data protection declaration at any time without prior notice and to inform customers, residents and business partners as well as users of the changes in an appropriate manner.

Changes to this data protection declaration apply from the time they are published on our website. The current version published on our website applies. The processing of personal data that was collected under an older data protection declaration is carried out in accordance with this data protection declaration.

5 Special information in connection with visiting our website

 

5.1 Cookies

5.2.2 Google Maps

Google Maps is used on the contact page of our website. By clicking on the map, a direct connection is established between your browser and the Google server and personal data is thus forwarded to Google.

5.2.3 Google ReCaptcha

Google reCaptcha is used to secure our website (https://www.google.com/recaptcha/intro/v3.html). This is a service from Google that distinguishes whether a certain action on the Internet is carried out by a human or by a computer program or bot. In this context, cookies (see section 14) are used.

By using Google ReCaptcha, personal data (in particular IP address, access location and time) is forwarded to Google. The purpose and scope of data collection and the further processing and use of the data by Google as well as your related rights and setting options to protect your privacy can be found in Google's data protection regulations (https://policies.google.com/privacy?hl=de). 5.2.4 Google Adwords Conversion Tracking

In order to statistically record the use of our website and evaluate it for the purpose of optimizing our website for you, we can also use Google Conversion Tracking. Google Adwords sets a cookie on your computer if you came to our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages on the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Every Adwords customer receives a different cookie. Cookies cannot therefore be tracked via the websites of Adwords customers. The information collected using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. Adwords customers find out the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, you will not receive any information that can be used to personally identify users.

5.3 Social media plugins

We use social plugins from the social networks Facebook, Twitter and Linkedin on our website to make our company better known. The underlying advertising purpose is to be viewed as the overriding interest. The responsibility for data protection-compliant operation must be ensured by the respective provider.

We integrate these plug-ins using the so-called two-click method in order to best protect visitors to our website.

Our website uses social media plugins from Facebook to make their use more personal. For this we use the “LIKE” or “SHARE” button. This is an offer from Facebook.
